A fight and assault — which law applies? · Yalla China

🤝 Governing law: 治安管理处罚法 / 刑法(故意伤害)

A minor dispute escalates into a physical fight — how do the authorities treat it?

Illustrative, general educational examples — not real specific facts and not legal advice; for awareness only. For an actual situation, consult a licensed lawyer.
The situation: two people argue in a public place; it turns into a physical fight and a bystander calls the police.

Applicable law: minor injuries are usually handled under the Public Security Administration Punishments Law (治安管理处罚法) — administrative detention and a fine. Moderate or serious injuries can be referred to the Criminal Law (intentional injury 故意伤害) and become a crime.

Typical outcome: both sides may be briefly detained for investigation; a medical report grades the injury; the person at fault may owe treatment compensation. For foreigners there can be consequences for residence status.

🎓 The lesson / takeaway

Lesson: walking away is the safest move. Even if you feel you are "defending yourself", you may still be detained for investigation. Don't answer violence with violence; document what happened (witnesses/cameras) and get a medical report immediately if hurt.
