Dividing Property in Divorce — What's Shared, What's Separate · Yalla China

🤝 Governing law: 民法典(婚姻家庭编)/ Civil Code (Marriage and Family)

In divorce, is everything really split down the middle?

Illustrative, general educational examples — not real specific facts and not legal advice; for awareness only. For an actual situation, consult a licensed lawyer.
The situation: A couple divorces after seven years. The husband owns an apartment bought before marriage, they saved money together during it, and the wife inherited a sum from her father.

Applicable law: The law distinguishes 'marital community property' (salaries and gains earned during marriage, usually split equally with regard to fairness, the weaker party and the children) from 'separate property' (what one owned before marriage, or received by inheritance/gift designated to them alone), which is not divided.

Outcome: The apartment stayed the husband's separate property (with partial compensation for loan repayments made during marriage from joint funds), the wife's inheritance stayed hers, and the joint savings were divided.

🎓 The lesson / takeaway

Lesson: Divorce doesn't mean 'fifty-fifty' on everything. Understand community versus separate property, and document where your money came from.
